When you visit our Sites, our servers automatically collect limited information about your computer when you visit our Sites, including via third party pixels and “cookies”. A “cookie” is a small text file that is recorded either temporarily or persistently on your hard drive that a website can use in order to recognize visitors and collect certain information to facilitate their ongoing access to and use of the website. This information may include the type of browser software you use, the operating system you are running, the IP address assigned to your computer or Internet connection, and the IP address of the website, if any, that referred you to our Sites. We use this information to understand how visitors navigate through our Sites, to enhance your experience while using our Sites, and to make the materials we post as valuable to visitors as possible.

Our Sites do not currently respond to browser-based “Do Not Track” signals

We are not currently engaging in such profiling that would entail us to make such significant decisions about you. 
• Restrict any automatic processing of your Personal Information including any automated profiling; and
• Complain to the appropriate Supervisory Authority.

We may provide links to other sites or resources provided by third parties. These links are provided for your convenience only.  We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party links on the Sites, you do so entirely at your own risk and subject to the terms and conditions of those sites.

We do not knowingly collect Personal Information from children under the age of 18 through our Sites, unless you have provided it. If you are under 18, we encourage you not to not give us any Personal Information. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Policy by instructing their children never to provide us Personal Information. If you have reason to believe that a child under the age of 18 has provided Personal Information to us, please contact us, and we will endeavor to delete that Personal Information from our databases.

The EU GDPR and UK GDPR distinguish between organizations that process Personal Information for their own purposes (known as “controllers”) and organizations that process Personal Information on behalf of other organizations (known as “processors”). We act as a controller with respect to Personal Information collected as you interact with the Website.

The EU GDPR and UK GDPR require a “lawful basis” for processing Personal Information. Our lawful bases include where:

• Consent: You have given consent to the processing of your Personal Information for one or more specific purposes either to us or to our service providers or partners.
• Contractual Necessity: Processing your Personal Information is necessary for the performance of a contract between you and us.

• Right to Delete/Be Forgotten: You may have the      right to request that we delete the Personal Information we have collected      about you, subject to certain legal exceptions.
• Right to Correct: You may have the right to      request that we correct any inaccurate Personal Information we have      collected about you.
• Right to Restrict Processing: You may have the right to require us      to restrict processing of your Personal Information.
• Right to Object: You may have the right to object the processing of your      Personal Information for direct marketing/profiling or where we are      processing your Personal Information for our legitimate interests.
• Right to Withdraw Consent: Where you have provided us with      consent the processing of your Personal Information, you may have the      right to withdraw such consent.
• Right to Not be Subject to Automated Individual      Decision-Making: You may have      the right to not be subject to a decision based solely on automated      processing that produces legal effects concerning you or similarly      significantly affects you.
• Right to Contact Supervisory Authority: You may have the right to contact the      relevant supervisory authority.

This section supplements our Privacy Policy on our websites, mobile applications, social media pages, and other technologies we own and/or operate, including in connection with our Sites and to our Services. Terms used in this section have the meaning ascribed to them in the CCPA.

The “Personal Information We Collect and Process” section above explains (1) the categories of Personal Information we collect from you, (2) the business or commercial purposes for using such information, depending on how you interact with us, and (3) each category of Personal Information is shared. We retain your Personal Information as described above in the “Retention of Personal Information” section. 

We do sell and  share your Personal Information (as such terms are defined under the CCPA). For more information about our privacy practices, please review our Privacy Policy.

  The “Personal Information We Collect and Process” section above explains how in the preceding 12 months, depending on how you interact with us, (1) the different categories of Personal Information and Sensitive Information we may have collected, (2) how we have disclosed such categories for business or commercial purposes, and (3) the sources we have collected such Personal Information from, and how that Personal Information is shared. 

Please note, we do not “sell” or “share” (as those terms are defined under the CCPA) your Personal Information. We may disclose certain Personal Information with our other clients and users of our Services, service providers, advertising and marketing companies, our business partners, and other third-party vendors as directed by you. We do not knowingly sell or share the Personal Information of California residents under 16 years old. For more information or to exercise your rights please see the “Your Rights” section below. 

Under the CCPA, certain personal information we collect and process may be considered “sensitive personal information” (e.g., passport number, driver’s license, state identification card, and citizenship and immigration status). The CCPA requires that we provide you with a right to limit our use or disclosure of such sensitive personal information in certain circumstances. Currently, we are not using your sensitive personal information for purposes that would require that we provide you with a right to limit.

Our Sale or Sharing of Personal Information 

Additionally, in the past 12 months, we may have sold or shared the following categories of personal information to the following categories of third parties and for the following business/commercial purposes: 

  If your Personal Information is subject to the CCPA, you may have certain rights, subject to applicable exemptions and limitations, with regard to such Personal Information, including the right to:

· Be informed, at or before the point of collection, of the categories of Personal Information to be collected and the purposes for which the categories of Personal Information shall be used.

· Request that we delete any Personal Information about you that we collected, subject to certain exceptions (“Request to Delete”).

· Correct inaccurate Personal Information (“Request to Correct”).

· Request that we, as a business that collects Personal Information about you and that discloses your Personal Information for a business purpose, disclose to you (“Request to Know”) the: (i) categories of Personal Information we have collected about you; (ii) categories of sources from which we collected the Personal Information; (ii)business or commercial purpose for collecting or selling the Personal Information; (iii) categories of third parties with which we disclose Personal Information; and (iv) specific pieces of Personal Information we have collected about you.

· Not be discriminated against because you exercised any of your rights under the CCPA.

· Opt-out of the “sale” (as that term is defined in the CCPA) of your Personal Information if a business sells your Personal Information (we do not).

· Opt-out of the “sharing” (as that term is defined in the CCPA) of your Personal Information if a business shares your Personal Information with third parties (we do not).

· Limit the use and disclosure of Sensitive Personal Information where required by the CCPA (“Right to Limit”) (please note that we are not using your Sensitive Personal Information for purposes that would require that we provide you with a right to limit).

The CCPA does not restrict our ability to do certain things like comply with other laws or comply with regulatory investigations. We also reserve the right to retain, and not to delete, certain Personal Information after receipt of a Request to Delete from you, where permitted by the CCPA or another law or regulation. 

If your Personal Information is subject to the CCPA, you may submit Requests to Know, Requests to Correct and Requests to Delete (“Consumer Rights Request”), you may exercise these rights by contacting by contacting us at 1-888-987-7577 or info@nsfertility.com. 

We are only required to respond to verifiable Consumer Rights Requests made by you or your authorized agent. When you submit a Consumer Rights Request, we may ask that you provide clarifying or identifying information to verify your request. Such information may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, your name and email address. Any information gathered as part of the verification process will be used for verification purposes only.  You are permitted to designate an authorized agent to submit a Consumer Rights Request on your behalf and have that authorized agent submit the request through the provided methods. We may deny requests from authorized agents who do not submit proof that they have been authorized by you to act on your behalf. We may also require that you directly verify your own identity with us and directly confirm with us that you provided the authorized agent permission to submit the request.

  Our websites and apps are not designed to respond to "do not track" requests from browsers.

“Shine the Light” and “Eraser” Laws: Residents of the State of California may request a list of all third parties to which we have disclosed certain information during the preceding year for those third parties’ direct marketing purposes.

North Star Fertility Partners, LLC (“we”, “us” and “our”) is providing this Consumer Health Data Privacy Notice (“Health Privacy Notice”) provided pursuant to the Washington My Health My Data Act (“MHMDA”) (RCW 19.373.005 to 19.373.900) and similar U.S. laws (collectively “Health Privacy Laws”.) The laws of your state or country of residence may not regulate our handling of your Consumer Health Data (“CHD”). As such, you may or may not be entitled to exercise or receive the rights and information described herein. 

This Health Privacy Notice supplements the information contained in our Privacy Policy and describes our collection, use and disclosure practices related to CHD we may collect about you about you through its operation of our website (https://www.nsfertility.com/) and mobile applications. This Health Privacy Notice also describes certain rights and options you have regarding your CHD. Please read this Health Privacy Notice carefully before providing us with your CHD. 

For purposes of this Health Privacy Notice, CHD is defined as any “personal information that is linked or reasonably linkable to a “consumer” (e.g., a resident of the state to which the law pertains) and that identifies the consumer’s past, present, or future physical or mental health status.” CHD does not include protected health information subject to the federal Health Insurance Portability and Accountability Act and its related regulations (“HIPAA”).
 

We may collect the following categories of CHD and share these categories of CHD, as described below in the “Our Sharing of CHD” section:

• Individual health conditions, treatment, diseases, or diagnosis.
• Social, psychological, behavioral, and medical interventions.
• Health-related surgeries or procedures.

• Other information that may be used to infer or derive data related to the above or other health information 

We may collect one or more of the following categories of CHD about our visitors to our Sites and individuals who use or may use our Services in the future. We collect CHD when these individuals (i) visit or interact with our Sites; (ii) request additional information about our Services, including through our chat features, forms and applications on the Sites; (iii) register for our Services or contact us; (iv) visit one of our locations; or (v) otherwise interact with us.

  We—and our service providers—may collect, process and use the CHD described in this CHD Privacy Notice for the following purposes:

• To provide our Services;
• To fulfill our legitimate interests, including to manage our business operations and optimize our media spend and service experience;

Unless specifically stated, we do not sell or share CHD to Third Parties for their own use. However, we may share or process CHD as defined in this notice with our affiliates and trusted partners in arrangements for purposes of targeted advertising, as the terms “sell,” “share,” “process,” and “targeted advertising” are defined in the Health Privacy Laws. In these arrangements, use of the information we share is limited by policies, contracts or similar restrictions.

We may share CHD to the following parties: 

• Service Providers, including those who work to enhance our Sites or Services,      support our practice management software systems or other customer service-related Services, conduct due diligence, and protect the security of our systems and networks.
• Other Business Partners, including to provide our Services to you or to host events.
• Your Medical Providers, including those clinics and doctors who are involved in your care.
• Intended Parents, those individuals who will benefit from the services of a surrogate.
• Legal/Regulatory Authorities, including to respond to a subpoena or court order,      judicial process, or regulatory inquiry; to defend against fraud, lawsuits, claims or other liabilities; and to prevent physical harm or financial loss in connection with any suspected or actual illegal activity.
• Purchasers of Business or Assets. Should we undergo any change in control,      including by means of a merger, acquisition, or purchase of substantially all of our assets, your CHD may be shared with the parties involved in such transaction.
• Other Third Parties. We share CHD with other third parties at your direction, including with your consent, where applicable, and/or as otherwise permitted by law. 

Subject to certain exceptions, under certain applicable laws related to CHD, you may have:

• The right to confirm whether we collect or share your CHD and to access such CHD including a list of the third parties and affiliates to whom the information may have been shared.
• The right to withdraw consent from our collection and sharing of CHD.
• The right to withdraw consent for selling of CHD. 
• The right to request changes to your CHD. 
• The right to delete your CHD.

Where the collection or use of your CHD is necessary for us to provide a product or service you have requested from us, we may collect and use your CHD without your consent. If we collect or use your CHD for other purposes, however, we will obtain your consent for such processing, where the law requires us to do so. Where consent is the basis for processing your CHD and where law permits, you have the right to withdraw your consent to such processing.

We will authenticate your requests and process it as required by law. Please allow up to 45 days for a response. If we deny your request, you may appeal that denial by email us at info@nsfertility.com.  If your appeal is unsuccessful, you can file a complaint with the relevant government body in your state, including:

• Washington State Attorney General at www.atg.wa.gov/file-complaint.
• Nevada State Attorney General at https://ag.nv.gov/Complaints/File_Complaint/. 

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. By accessing and using the Sites after we notify you of such changes to this Privacy Policy, you are deemed to have accepted such changes.  Please refer back to this Privacy Policy on a regular basis.
